2. COMPANY AS SALES AGENT
Dick Jensen and Alan McKay Tours, LLC dba Jensen McKay Tours (hereinafter “Company”) acts as a sales agent for any airline, hotel, car-rental company, bus or motorcoach operator, tour operator, cruise line, vessel operator, railway, or other service or accommodations provider named in your itinerary or used on your Tour (hereinafter “Suppliers”). All Suppliers are independent from Company. Company does not own, manage, or operate any air carrier, aircraft, bus, motor vehicle, vessel, cruise ship, railway, nor other mode of transportation, nor any hotel, restaurant, place of lodging, short-term residence, or other accommodation. Your airline ticket, passenger ticket, guest agreement, or other Supplier terms and conditions are a contract between you and the air carrier, vessel operator, hotel operator, or other Supplier only, even if you purchase through Company. By purchasing your services through Company, you waive all liability of Company for such services, to the extent allowable under applicable law.
3. LIMITATION OF LIABILITY
Company is not responsible for acts or omissions of Suppliers or other parties, including, but not limited to, acts or omissions causing death, personal injury, or loss or damage to personal property or baggage, or failure to provide services or adhere to schedules, or cessation of service or bankruptcy. You acknowledge that activities planned on the Tour are subject to be cancelled due to inclement weather or other factors and that refunds are usually not available for cancelled events. You hereby release Company from all claims arising out of any death, injury, damages, or other loss covered in this paragraph.

The Company assumes no responsibility for and shall not be liable for any refund, death, personal injury, loss or damage to personal property or baggage, or other loss, accident, delay, inconvenience, damages, or irregularity which may be caused by or related to: (1) any acts or omissions, defaults, or wrongful or negligent acts or omissions of Suppliers; (2) any defect in or failure of any vehicle, vessel, craft, equipment or instrumentality owned, operated, or otherwise used or provided by Suppliers; (3) any act or omission, or wrongful or negligent act or omission on the part of any other party not under Company’s direct control in a principle-agent relationship; or (4) acts of terrorism, natural disaster, weather, strike, labor trouble, riot, civil unrest, act of government authority, acts of God, force majeure, pandemic, endemic, communicable disease, or any other contingency not under the reasonable control of Company. You hereby release Company from all claims arising out of any incident, loss, or damage covered in this paragraph. You accept that all payments to Company are non-refundable. You also accept that all payments to Company are non-transferable to other individuals and non-transferable to another tour.
4. SUPPLIERS’ SEPARATE TERMS
You acknowledge and understand and agree that: (1) airlines, cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions and that you may be bound by those contracts regardless of whether you receive notice of their terms; (2) Airline schedule changes, mechanical or weather delays may affect flight times. Your connecting flights and/or transportation to and from the start and end point, whether issued by the Company or on your own arrangement may be affected. Company is not responsible for missed connections, delays, and/or cancellations. Once your first flight has commenced the air carrier controls your reservation. Any flight delays, missed connections, or cancellations must be re-scheduled by the responsible airline. By acceptance of this Tour Agreement, you consent to those terms and conditions.
You authorize Company to provide your credit card information to suppliers to make payment for their services on your behalf (only applies for airline upgrades - we do not store nor have access to your credit card information for online orders).

If the Company processes your credit card as payment, you agree to the following: the Company services consist of facilitating the sale and paying the Suppliers, and once the Company provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operation, your only recourse will be against the Supplier.

5. TRAVEL CONDITIONS, REQUIRED DOCUMENTS, AND FOREIGN TRAVEL
Company has no special knowledge regarding the financial condition of Suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, or suitability of booked services for any person. For information concerning possible dangers at destinations, Company recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information Company recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You may be detained if you bring unauthorized medications or substances into the country you are traveling to that may even be legal in the United States but not in the country you visit. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Company from all claims arising out of any problem covered in this paragraph.
You understand that the Transportation Security Administration (TSA) requires you to carry a government issued identification card in order to board a flight. You further acknowledge that you must present a driver's license or other form of identification that complies with the requirements of the Federal Real ID Act (see www.dhs.gov/real-id for more information). You have been advised that the name, date of birth and gender that appears on the ID card must exactly match the same such data that is listed on your airline ticket(s) and in booking record(s). You acknowledge that failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint.
Further, a government issued, non-expired U.S. passport book (with at least four blank visa pages) is required, regardless of age, for the destinations to which you are traveling. The name on your reservation must match exactly the name on your passport. Look at the expiration date on your passport. Please make sure your passport is valid for at least 6 months after travel is completed. (Some countries require one year or longer.) Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. U.S. citizens may be denied entry to a country if they have ever been charged or convicted of a serious crime, including a DUI. Disability accommodations vary widely by country and supplier. It is your responsibility to disclose any disability that may impact travel and to provide the correct documentation as described. Failure to do so may result in denied boarding or entry. We are unable to refund unused flights, hotels, or add-ons because of denied boarding or denied entry to a foreign country. For more information, please visit www.travel.state.gov, U.S. Dept. of Homeland Security. or the U.S. Consulate for foreign countries included in your itinerary.
You agree to review your travel documents for accuracy upon receipt and understand that you may contact the Company if you have any questions. You understand that discounted fares typically involve restrictions and that changing any aspect of your travel arrangements may result in the payment of additional money.
For your protection, Company recommends that you purchase a travel protection plan. Travel protection can be purchased up until the day prior to travel. However, maximum benefit limitations may apply including, but not limited to, waivers regarding pre-existing conditions.
6. TIME LIMITATIONS AND PROCEDURES FOR CLAIMS OR COMPLAINTS
Any complaint or claim involving your Tour or the services offered by the Company, or involving the negligence of any tour operator, supplier of travel packages, supplier of services (including Suppliers), subcontractor, or agent in relation to any service provided to you, must be made to the Tour Leader immediately while you are on the trip.
Written notification of any complaint or claim must be submitted to Jensen McKay Tours, 347 North 300 West, Suite 202, Kaysville, UT 84037, and must be received within 180 days after completion of the Tour, except where such limitations are prohibited by law. Any claim against the Company must be brought within one year after the date of completion of the Tour and not later, except where such limitation is prohibited by law.
7. AUTHORITY TO REMOVE OR REFUSE TRAVELERS
You acknowledge and agree that, in the sole discretion of Company, including, but not limited to, the Tour Leader, Company may refuse to provide services to you, refuse to allow you to book Tours with Company, or may require you to leave the Tour if it is reasonably believed that you:
-
Are a danger to yourself or others;
-
Have engaged in, are engaged in, or are threatening to engage in behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other Travelers, Suppliers, the Tour Leader, Company representatives, other participants or guests of excursions or other Suppliers, or any other person or persons, including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, obscene, or discriminatory (including as to race, religion, sex, sexual orientation, gender identity, national origin, disability, age, marital or family status, or citizenship or immigration status); or
-
Have failed or refused to follow, or are failing or refusing to follow, the Company’s, Tour Leader’s, or Supplier’s rules and procedures or the instructions of the Company, the Tour Leader, or Suppliers.
If you are removed, you may be left at any city, port, or place that is serviced by publicly available transportation without liability to Company, the Tour Leader, Supplier, or their or our representatives. Company is not required to refund any portion of the amount paid if you are removed under this section.
If you are removed, the Company and/or Supplier will not be responsible for your expenses for lodging, medical care, meals, transportation, or any other expenses you incur. Company is entitled to recover from you any costs or expenses incurred by Company, Suppliers, or our or their representatives in connection with your removal or the exercise or enforcement of this clause. Traveler shall assume full responsibility for arranging Traveler’s own airfare home and covering all associated expenses. Furthermore, if you violate any government regulations or rules set forth by our Tour Leader and/or Supplier, you will similarly be removed from the Tour and be held accountable for arranging your return airfare and all related costs.

8. PHOTOGRAPHS, AUDIO AND VIDEO RECORDINGS
Traveler acknowledges that photographs or audio or video recordings taken of Traveler during the Tour may be utilized for promotional purposes. By participating in any Tour and/or by agreeing to these terms, you willingly waive any rights you may have to these photographs or audio or video recordings. Traveler grants, on behalf of themselves and any minor children traveling under their care on the Tour, and all other travelers associated with Traveler’s reservation, to Company the right to photograph, film, tape and/or record their likenesses, voices and appearances and the right to display, use, reuse, broadcast, rebroadcast, publish, and/or republish photographs, audio, video and/or film recordings of their name, image, physical likenesses, voices and appearances. Traveler grants (and represents and warrants that Traveler has the right to grant on behalf of themselves and any minor children under their care and all other travelers associated with Traveler’s reservation) to Company, and their successors and assigns, including without limitation any third party that any of them may authorize, the right to display, use, reuse, broadcast, rebroadcast, publish, and/or republish their names, likenesses and/or biographies as well as any photography and/or audio and visual recordings as Company may desire, in all media, whether now known or hereafter devised, throughout the universe in perpetuity or the maximum period permitted by applicable law (including, without limitation, in videos, advertisements, promotions, motion pictures, films, newspapers, magazines, on radio broadcasts, websites, social media pages or advertisements, or other online content) and in all forms including digitized images, whether for advertising or promotional purposes or for any other commercial or other purpose whatsoever, without further compensation to Company or any limitation whatsoever. Traveler further agrees that Company’s permission to use any of the foregoing shall include the right without Traveler’s prior consent to edit, alter or otherwise modify any of the foregoing as Company shall see fit.
Further, if Traveler provides or submits any photographs or audio or video recordings to Company or to Company’s Tour Leader, employees, or agents, Traveler represents and warrants that (a) the photograph or audio or video recording is Traveler’s original work created solely by Traveler and does not infringe the intellectual property rights of any party; (b) Traveler has obtained any and all necessary releases from subjects depicted in said original work; (c) Traveler grants to Company a worldwide, royalty-free, perpetual, transferable, irrevocable, non-exclusive and fully sublicensable right and license to use, in any and all media, in perpetuity, anywhere in the world, whether for advertising or promotional purposes or for any other commercial or other purpose whatsoever, without further compensation or any limitation whatsoever. Traveler further agrees that Company’s permission to use any of the foregoing shall include the right without Traveler’s prior consent to edit, alter or otherwise modify any of the foregoing as Company shall see fit.

9. PHYSICAL LIMITATIONS, MEDICAL ISSUES, AND DISABILITIES
Traveler understands and agrees that it is essential to have the physical capability to walk throughout the Tour. Tours are not wheelchair or motorized scooter accessible, as wheelchair or motorized scooter assistance or accessibility in international destinations cannot be guaranteed. Traveler is encouraged to report any disability requiring special attention to Company before any reservation is made. Company will make reasonable efforts to accommodate the special needs of Travelers and Tour participants, however, not all requests or needs can be accommodated. Travelers should be aware that the Americans with Disabilities Act is inapplicable outside of the United States and facilities outside the United States for disabled individuals are limited. We cannot accommodate women past their sixth month of pregnancy, cannot accommodate service animals, and do not allow children under the age of ten (10) to participate in any Tour.
In the event that Company and/or Tour Leader determines that there are significant difficulties with your mobility or other ability to participate in the Tour, you may be requested to stay on the bus, stay at your hotel, and/or depart from the group. In such circumstances, you shall be responsible for arranging your own transportation and covering all expenses associated with your return home.
Company, Tour Leaders, or other Company personnel, or Suppliers, will not physically lift or assist passengers into transportation vehicles. Tour leaders and Company are unable to help during medical emergencies. The Tour group will move on if you are hospitalized and/or unable to continue with the Tour. The Company will not be able to assist you. You are responsible for medical expenses including but not limited to hospital stays, air ambulances and other medical evacuations, which are Traveler’s responsibility. In the case of death, repatriation of remains is also your responsibility.
If you have a condition, physical limitation, mobility issue, or other special need, you travel at your own risk. Company is not liable for any injuries or damages you may incur relating to such a condition, including without limitation, loss of special equipment, lack of assistance with or accommodation of special needs, and unavailability of medical assistance or treatment.
10. MANDATORY ARBITRATION, CHOICE OF FORUM AND LAW, CLASS ACTION WAIVER, WAIVER OF JURY
AGREEMENT TO ARBITRATE: Any and all disputes, claims, or controversies whatsoever, including, but not limited to, personal injury, illness or death, whether based on contract, tort, statutory, constitutional or other legal rights, including but not limited to alleged violation of civil rights, discrimination, consumer or privacy laws, or for any losses, damages or expenses, relating to or in any way arising out of or connected with this Tour Agreement or the Tour, or the booking of the Tour, no matter how described, pleaded or styled, between the Traveler and Company shall be referred to and resolved exclusively by binding arbitration to be administered and conducted by the American Arbitration Association under its then-existing rules using one mutually selected arbitrator or, if the parties cannot agree on an arbitrator, using an arbitrator selected by the American Arbitration Association, solely in Salt Lake City, Utah, U.S.A. to the exclusion of any other forum. Traveler hereby consents to such exclusive jurisdiction and waives any jurisdictional, venue or other objection that may be available to any such arbitration proceeding in Salt Lake City, Utah. The arbitration shall be administered by the American Arbitration Association under its Rules and Procedures and the fee schedule in effect at the time of initiating the proceeding with the American Arbitration Association, which are deemed to be incorporated herein by reference. Each party shall bear their own costs and fees associated with any such filing.
NEITHER PARTY WILL HAVE THE RIGHT TO A JURY TRIAL OR TO ENGAGE IN PRE-ARBITRATION DISCOVERY EXCEPT AS PROVIDED IN THE APPLICABLE ARBITRATION RULES AND HEREIN, OR OTHERWISE TO LITIGATE THE CLAIM IN ANY COURT. THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. OTHER RIGHTS THAT TRAVELER OR COMPANY WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.
VENUE SELECTION AND JURY WAIVER: An award rendered by an arbitrator may be entered in any court having jurisdiction. In the event the arbitration provision is deemed unenforceable by an arbitrator or court of competent jurisdiction for any reason, then and only then, all disputes and matters whatsoever arising under, in connection with or incident to this Tour Agreement or the Tour, shall be litigated, if at all, before the courts of the State of Utah, U.S.A., and specifically the Utah Third Judicial District Court in Salt Lake City, Utah, to the exclusion of the courts of any other county, state or country. Traveler hereby consents to such exclusive jurisdiction and waives any jurisdictional, venue or other objection that may be available. Traveler and Company each waive any right to a trial by jury in any action or proceeding to enforce or defend any rights under this agreement or related to the Tour.
CHOICE OF LAW: Except as expressly provided in the Agreement to Arbitrate herein, any and all disputes whatsoever arising out of or relating to this Tour Agreement or the Tour as well as the interpretation, applicability and enforcement of this Tour Agreement shall be governed exclusively by the laws of the State of Utah, without regard to choice of law rules, which replaces, supersedes and preempts any provision of law of any other state or nation.
CLASS ACTION WAIVER: THIS TOUR AGREEMENT PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING TRAVELER TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES TRAVELER FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER THIS TOUR AGREEMENT OR IN CONNECTION WITH THE TOUR. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, TRAVELER AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST COMPANY WHATSOEVER SHALL BE LITIGATED BY TRAVELER INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION. TRAVELER EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. TRAVELER FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE ARBITRATION OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ARBITRATE CLAIMS. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW AND NOT BY AN ARBITRATOR. IF FOR ANY REASON THIS CLASS ACTION WAIVER IS UNENFORCEABLE AS TO ANY PARTICULAR CLAIM, THEN AND ONLY THEN SUCH CLAIM SHALL NOT BE SUBJECT TO ARBITRATION. TRAVELER AGREES THAT COMPANY CAN RECEIVE IMMEDIATE JUDICIAL ASSISTANCE TO ENFORCE THIS CLASS ACTION WAIVER.
11. SEVERABILITY
The invalidity of any provision of the Tour Agreement shall not invalidate the Tour Agreement or its remaining provisions. If it is determined that any provision of the Tour Agreement violates any law, or is otherwise invalid or unenforceable, then that provision shall be revised to the extent necessary to make that provision legal and enforceable. In such case, the Tour Agreement shall be construed, to the fullest extent permitted by law, to give effect to the parties’ intentions and purposes in executing the Tour Agreement.

12. HEADINGS
Section or paragraph headings included herein are for convenience of reference only and shall not modify, define, expand or limit any of the terms or provisions hereof.
13. TOUR CHANGES
Company reserves the right to modify Tour itineraries and substitute hotels, modes of transportation, local tours, and accommodations without liability. Included trips, attractions, and/or features may not be available for all Tours. Although Company strives to provide Tours as close to described as possible, Company reserves the right to modify the itinerary when necessary in Company’s reasonable discretion, without prior notice, and without liability for any losses Traveler may incur as a result of such cancellations, modifications, or deviations.
14. CANCELLATION AND NON-REFUNDABLE PAYMENTS
Company does not provide refunds for cancellations initiated by Traveler. All deposits, payments, or other expenses paid to Company are non-refundable and non-transferrable without exception. You accept that all payments to Company are non-refundable. You also accept that all payments to Company are non-transferable to other individuals and non-transferable to another Tour. We recommend purchasing travel insurance to protect from unforeseen cancellations.
Full payment is due 130 days before the Tour and must be paid by check, not by credit card. Reservations will be cancelled if full payment is not received within ten (10) days after the due date and deposits will be forfeited. Tips and gratuities for local guides and bus drivers are not included in the Tour price.
